通过拍卖方式申请文物拍卖许可的企业应当具备下列条件：

(一)注册资本1000万元以上，且不是中外合资、中外合作、外商独资企业

(二)有5名以上文物文博专家；

(四)近两年内没有非法经营文物的行为；

(五)法律和法规规定的其他条件

(三)文物拍卖行业人员的相关证明文件和聘用协议复印件；

   依法设立的拍卖企业应当取得省、自治区、直辖市人民政府文物行政部门颁发的文物拍卖许可z。在申请经营资格之

前，申请文物拍卖许可z的公司需要注册公司实体和已成功办理的普通拍卖经营许可z才可以申请。
